The agreement between you and NewsUSA when you use the Media Catalogue and order placements.

1. Agreement
These Terms are a contract between you and NewsUSA Inc. ("NewsUSA", "we", "us"), a Virginia corporation at 1104 West Broad St. #1024, Falls Church, VA 22046, United States. By creating an account or placing an order on the NewsUSA Media Catalogue (the "Service") you agree to them and to our Privacy Policy. If you use the Service for a company, you confirm you are authorised to bind it.
2. Eligibility and accounts
- You must be at least 18 and using the Service for business purposes.
- You must give accurate details, keep them current and verify your email address. You are responsible for everything done under your account and for keeping your password private. Tell us at once if you suspect unauthorised use.
- We may suspend or close an account that breaks these Terms, presents a security risk, or has been inactive for an extended period.
3. The catalogue and prices
- The catalogue lists media placements NewsUSA can arrange, with a price per placement that includes the writing and editorial work described on the listing.
- Prices are quoted in US dollars and are current catalogue rates at the time shown. Publications, availability and prices change; a listing may be withdrawn or repriced at any time before an order is confirmed.
- Metrics such as domain authority, domain rating, traffic and turnaround are supplied by third-party measurement services and publishers. They are indicative, not guaranteed.
4. Orders
- Placing an order is a request. It becomes binding only when a NewsUSA specialist confirms availability, timing and the final price with you in writing.
- The price shown at checkout is a snapshot; if a publication has repriced or is unavailable, we will tell you before confirming and you may accept the change or cancel that line.
- Discount codes are applied at checkout, are subject to their stated conditions (minimum order, expiry, number of uses), may not be combined unless we say so, and may be withdrawn if misused.
- Where online payment is offered, you pay at checkout by card through Stripe, our payment processor; NewsUSA never sees or stores your card details. Where it is not, confirmed orders are invoiced by NewsUSA on the terms stated on the invoice. Payment is due before publication unless we agree otherwise.
- If a placement you have paid for cannot go ahead, we refund that line to the original card. Refunds are processed by Stripe and typically appear within 5 to 10 business days.
5. Content and editorial
- You will provide accurate, lawful information about your brand for the placement, and you warrant that you hold the rights to any material you supply and that it does not infringe anyone's rights, defame anyone, or break advertising or consumer law.
- Publishers keep editorial control. A publication may edit for style and length, add a sponsored or partner disclosure where its policy or the law requires one, decline content that does not meet its standards, or take a piece down for a policy or legal reason. Where a placement is declined, we will offer an alternative or a refund of that line.
- NewsUSA and its writers retain rights in the writing we produce until the order is paid, at which point you receive a licence to use the published piece for your own promotion, with attribution to the publication.
6. Cancellations and refunds
- You may cancel an order line at no charge any time before the specialist confirms it.
- After confirmation, writing begins and publisher slots are reserved; cancellation is at our discretion and may incur the cost of work done.
- Once a placement is published, it cannot be cancelled or refunded.
7. Acceptable use
You will not: scrape or bulk-download the catalogue; probe, circumvent or overload our security and rate limits; share or resell access; create accounts with false details or for someone else without permission; guess discount codes or other people's credentials; upload malware; or use the Service for anything unlawful. We may throttle, suspend or terminate access for any of these without notice.
8. Intellectual property
The Service, its catalogue, design, text, data and software belong to NewsUSA or its licensors. Publication names and logos belong to their owners and appear only to identify the outlet. You get a limited, revocable, non-transferable licence to use the Service for your own business.
9. Disclaimers
The Service and the catalogue are provided "as is". NewsUSA does not warrant that any placement will produce a particular result, such as sales, traffic, search ranking or AI citation, or that third-party metrics are accurate. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Limitation of liability
To the fullest extent the law allows, NewsUSA is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or goodwill, arising from the Service or any order. Our total liability for any claim is limited to the amount you paid NewsUSA for the order concerned in the twelve months before the claim, or US$100 if greater.
11. Indemnity
You will defend and indemnify NewsUSA, its officers, employees and partners against claims, losses and costs (including reasonable legal fees) arising from your use of the Service, the material you supply, or your breach of these Terms or the law.
12. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Before starting any proceeding, the parties will try in good faith to resolve the dispute informally for 30 days after written notice. Any dispute not so resolved will be settled by binding arbitration in Falls Church, Virginia, administered by the American Arbitration Association under its Commercial Arbitration Rules. Claims are brought individually only; class actions and class arbitrations are waived. Either party may seek injunctive relief in court to protect intellectual property.
13. Changes to the Service and these Terms
We may change the Service and these Terms. Changes to the Terms take effect when posted here with a new date; material changes will be emailed to account holders. Orders already confirmed stay on the Terms in force when they were confirmed.
14. General
If part of these Terms is unenforceable, the rest stands. Our failure to enforce a term is not a waiver. You may not assign these Terms; we may assign them to a successor. These Terms, the Privacy Policy and your confirmed order form the whole agreement between us for the Service.
